As a towing and recovery business operating in the UK, keeping up with changing driving laws isn’t just good practice – it’s essential for compliance, safety, and operational efficiency. April 2026 brings several significant legislative updates that directly affect how we work, from licence requirements to vehicle taxation and recovery procedures.
Here is everything you need to know about the major changes coming into force this April.
1. Motor Vehicles (Driving Licences) (Amendment) Regulations 2026 – Effective 27 April 2026
The most important change for recovery operators comes from the Motor Vehicles (Driving Licences) (Amendment) Regulations 2026, which take effect on 27 April 2026.
While the full text of the amendment is still being finalised, early guidance confirms updates to:
- Trailer towing entitlements – Drivers who passed their car test after 1 January 1997 will see clarification on maximum authorised mass (MAM) for towed combinations. The changes align with post-Brexit retained EU law adjustments, making it easier for recovery drivers to legally tow heavier loads without additional tests, provided they meet specific training requirements.
- Medical fitness renewals – Stricter medical reporting rules for drivers over 45 who hold vocational entitlements (C1, D1) will apply. Many recovery operators drive vehicles just under 7.5 tonnes – this change means more frequent self-certification of fitness to drive.
- Digital licence verification – The amendment formally recognises digital driving licences (via the GOV.UK One Login app) for roadside checks by police and DVSA, streamlining identity and entitlement verification.
What this means for you: Review your fleet drivers’ licence entitlements before 27 April 2026. Ensure any driver towing trailers or operating recovery trucks over 3.5 tonnes understands the updated category rules. Consider refresher training on towing safety and legal load limits.
2. Vehicle Excise Duty (VED) Changes – From 1 April 2026
From 1 April 2026, VED rates rise in line with the Retail Prices Index (RPI). Key changes for recovery fleets and the vehicles you handle:
- Standard VED rate – Increases from £195 to £200 per year for most petrol and diesel cars registered after 1 April 2017.
- Electric vehicles (EVs) – For the first time, EVs registered from 1 April 2017 onwards will pay the standard rate of £200. Zero-emission vehicles are no longer exempt. This applies even to EVs you recover that were previously tax-free.
- Expensive Car Supplement (ECS) – The planned increase of the ECS threshold from £40,000 to £50,000 has been removed. The supplement (currently £410 per year for years 2-6 of a vehicle’s life) continues to apply to any car with a list price above £40,000. This affects a wider range of newer vehicles, including many EVs and high-spec recovery vehicles themselves.
What this means for you: When quoting for recovery or storage, remember that EV owners may now face higher annual running costs, potentially affecting their willingness to pay for premium recovery services. Also check whether any of your own recovery fleet vehicles fall into the Expensive Car Supplement category – your operating costs may rise.
3. Smart Motorway Safety and Breakdown Procedures
While not a “driving law” change per se, April 2026 sees the full rollout of mandatory emergency signage and radar-based stopped vehicle detection (SVD) on all all-lane running (ALR) smart motorways in England. This follows continued pressure from the RAC and AA after 2024 breakdown data showed 283,000 incidents on England’s motorways alone.
Recovery operators now face stricter rules on accessing live lanes – only vehicles with approved rear-facing red flashing beacons and DVSA-approved training can stop to assist in ALR sections without immediate police escort.
What this means for you: Ensure your recovery vehicles are equipped with compliant warning systems and that your drivers have completed the latest National Highways “Recovery on Smart Motorways” e-learning module. Failure to comply could result in fines or being barred from certain motorway contracts.
